Americans with Disabilities Act Attorneys
The Americans with Disabilities Act is one of several protections for people who suffer from disabilities, designed to help prevent discrimination in the workplace and elsewhere. Because the act is fairly complex, it can be hard for many people to truly understand their rights. Our disability discrimination attorneys are committed to ensuring our employer clients properly conform to the requirements of the law while also ensuring employees do not demand rights beyond the scope of the law.
In its entirety, ADA law covers a number of practices such as recruitment, hiring, firing, promotion, job assignments and much more. A person is considered to have a disability under the law if he or she has a physical or mental impairment that limits a major life activity. The law also protects those with a history of disability.
In order to be covered under the ADA, the impairment must be substantial, such as disabilities that limit speaking, seeing, hearing, walking and other major life activities. In any case, the person must be qualified to perform the essential functions of the job in order to be covered under the ADA. Any employer with 15 or more employees must comply with these provisions.
The act prevents discrimination against people with disabilities and guarantees those with disabilities have equal opportunities in employment, transportation, public accommodations, government services, and telecommunications. However, the law only extends so far, and oftentimes, employees make demands outside the scope of this law that employers cannot reasonably comply with. In these cases, our ADA lawyers are here to help you.
