Vero Beach Drowning Accident Lawyers
Vero Beach, FL
In Florida’s Treasure Coast region, swimming is an incredibly popular pastime. Whether you go for a dip in the ocean, swim in a community pool, or enjoy a private pool at someone’s house, it’s a great way to enjoy the sun, cool off, get exercise, and have fun. But swimming can also be dangerous. According to the Centers for Disease Control and Prevention (CDC), Florida has one of the highest unintentional drowning rates in the country.
If a loved one died in a drowning accident, you may be able to pursue a personal injury lawsuit against the at-fault party. Through a wrongful death claim, surviving family members can recover financial compensation for their losses, including pain and suffering, loss of support, and medical bills and funeral and burial expenses. Our Vero Beach personal injury attorneys can work with you to help you seek justice after the loss of a loved one.
Gould Cooksey Fennell offers experienced, compassionate legal representation to individuals and families whose lives have been affected by all types of accidents. We handle all personal injury cases on a contingency fee basis so that you won’t pay a fee unless we recover money for you. Filing a Personal Injury Claim for a Drowning Accident
If a loved one has been in a drowning accident, you may be able to file a claim against the person or entity responsible. These cases are usually based on a theory of negligence or carelessness. For example, if a community pool did not hire enough lifeguards to properly scan and monitor swimmers, it might be held liable if someone drowns.
In some situations, drowning accidents occur because of intentional or reckless conduct. For example, if a boat owner operates it recklessly and causes an accident that leads to a drowning, they may also be held responsible for their actions. A civil case is separate from any criminal action that local prosecutors may bring for the same accident.
There are two potential types of personal injury claims that may be brought for a drowning accident. If the person dies as a result of the accident, then their surviving family members may file a wrongful death lawsuit. If they survive a near-drowning, they can pursue a standard personal injury lawsuit for their losses.
With a typical personal injury lawsuit, the victim (plaintiff) may seek financial compensation from the at-fault party (defendant) for their losses. If the victim has more serious injuries, a family member could bring the lawsuit on their behalf. In either case, the plaintiff will need to prove that the defendant’s negligent, reckless, or intentional conduct caused their injuries and that they suffered damages as a result. For example, if a child is permanently disabled from a non-fatal drowning at a neighbor’s pool that was not properly fenced, their parents could file a lawsuit to recover compensation for their child’s injuries.
A wrongful death claim is a different type of personal injury claim. This type of lawsuit can be filed in situations where the deceased person could have filed their own lawsuit if they had survived their injuries. If a person dies as a result of a drowning accident, then their surviving relatives can pursue a wrongful death action.
In Florida, the personal representative or executor of the estate brings the case. They are filing the lawsuit on behalf of the estate and any surviving family members. As with other types of personal injury claims, this type of lawsuit must be filed within 2 years of the date of the accident (with some limited exceptions).
The challenge in many of these cases is proving that the defendant was responsible for the drowning accident. Our Vero Beach drowning accident attorneys are adept at gathering the necessary evidence to prove your case. This may include interviewing witnesses, requesting photos and videos of the accident scene, requesting employment and training records, and consulting with expert witnesses.
Most personal injury claims are resolved outside of court. Our team of skilled litigators works hard to resolve your case quickly and for as much money as possible. If the defendant’s insurance company won’t offer you a fair settlement, we will take the case to trial and ask the jury to return a verdict in your favor.
Compensation in a Drowning Accident Case
In a personal injury case, you may recover financial compensation (damages) for all of your losses. The amount and type of damages that you recover will be based on the facts of your case.
In a standard personal injury case, you may recover:
- Economic damages for your direct financial losses, such as lost wages, reduced earning capacity, medical bills, property damage, and future medical treatment.
- Non-economic damages for your intangible losses, including pain and suffering, loss of enjoyment of life, emotional distress, scarring, and disfigurement.
- Punitive damages in cases involving intentional or reckless conduct. These damages are only awarded in cases involving something more than negligence or carelessness. In Florida, punitive damages are capped at the greater of $500,000 or 3 times compensatory (economic plus non-economic) damages.
Â
Wrongful death claims may result in slightly different compensation. This may include:
- Damages paid to the surviving family members, such as mental pain and suffering, loss of support and services, loss of companionship and protection, loss of parental guidance, medical expenses, and funeral expenses paid by the family.
- Damages paid to the estate, including lost wages and benefits, the value of wages and benefits that the deceased person could have earned in the future, and medical and funeral expenses paid by the estate.

As experienced Vero Beach wrongful death lawyers, our goal is to help our clients get maximum compensation for their loss, along with justice for the loss of their loved one. Common Causes of Drowning Accidents
In Florida, a warm climate means plenty of opportunities to get outside and swim. Many homes and communities have swimming pools. There are also plenty of opportunities to swim in the Atlantic Ocean along Florida’s Treasure Coast.
There are several common causes of drowning accidents. This includes:
- Lack of swimming ability: The most common cause of drowning is either not knowing how to swim or being a poor/weak swimmer. Both adults and children who either can’t swim or who aren’t strong swimmers might experience drowning.
- Inadequate supervision: Drowning can happen anywhere, including in relatively shallow bodies of water. Pools and public beaches should have lifeguards on duty to monitor swimmers and intervene if necessary.
- Failure to wear life jackets: Many drowning accidents related to boating can be prevented through the proper use of an approved life jacket. If a boating accident occurs, having enough life jackets on board for every adult and child can prevent drownings.
- No barriers around a pool: To reduce the risk of drowning, pools should be fenced with a locking mechanism. This is particularly crucial to prevent children from accessing a pool without adult supervision.
- Alcohol use: Being under the influence of alcohol and/or drugs can impact your judgment, reflexes, coordination, and balance. This can increase the likelihood of drowning accidents for teens and adults.
Â
Each year in the United States, there are 4,000 fatal unintentional drownings. That works out to an average of 11 drowning deaths each day. There are also 8,000 non-fatal drownings per year in the U.S.
A non-fatal drowning occurs when a person is under the water and breathes water into their lungs. When this happens, their lungs cannot supply oxygen to their body. Near drownings can cause a number of long-term effects, including brain damage, memory loss, seizures, stroke, motor skill impairment, respiratory problems, post-traumatic stress disorder (PTSD), anxiety, and/or depression.
While some drownings are purely accidental, others are linked to negligent, reckless, or intentional conduct. In these situations, you may be able to file a personal injury lawsuit against the at-fault party with the help of a Vero Beach drowning accident lawyer.
