GCF’s Trial Team Earns $3.9 Million Jury Verdict for Car Accident Victim

After a week-long trial in Indian River County, GCFโ€™s personal injury team of Dane Ullian, Jason Odom and David Carter secured a jury verdict of almost $3.9 million dollars to a very deserving ย GCF client. ย The case arose out of a 2019 โ€œT-boneโ€ automobile crash caused by an inattentive driver who ran a stop sign and collided with GCFโ€™s client while was on his way home after assisting a local charity.ย  As a result of the crash, GCFโ€™s client suffered multiple fractures and a mild traumatic brain injury with permanent symptoms.

Before GCF filed suit, the defendantโ€™s insurance company, State Farm, failed to fairly evaluate the claim by offering GCFโ€™s client less than $39,000.00.  As a result of this grossly insufficient offer, GCF filed suit and proceeded to trial.  After hearing several days of liability and medical evidence, the jury took a little over 3 hours to return a verdict of just under $3.9 million, approximately 100 times the amount originally offered by State Farm.

NOTABLE SETTLEMENTS AND VERDICTS

A 52 year old man arrived at a hospital ER with a UTI, resulting in negligent, non-emergency intubation that caused the catastrophic anoxic brain injury leading to his death. After a trial involving complex medical and technical issues relating to critical care medicine, infectious disease, hospital administration, and electronic medical record systems, the family obtained a wrongful death settlement of $31.9 million.

Trial arising from failure to diagnosis colon perforation after a laparoscopic hysterectomy surgery causing permanent injury to the Plaintiff. After a three week trial a Martin County jury rejected the Defendantsโ€™ position finding the hospital 70% responsible for Mrs. Mooreโ€™s damages and the physician 30% responsible. The award included just over $600,000 for past medical expenses, $370,000 in future medical care, and non-economic damages of almost $2 million.
